XPLORENCE TERMS OF USE
User Agreement

Welcome to the official corporate website of consulting company Xplorence (hereinafter 'Company', 'we', 'us', or 'our'). This User Agreement (hereinafter 'Agreement') constitutes a public offer and establishes legally binding rules, terms, and restrictions for accessing our website, its subdomains, services, interfaces, and published materials.
By using this website, viewing its pages, registering, or submitting an application to the Expert Pool, you confirm that you have read, understood, and unconditionally agree to comply with these Terms in full. If you are acting on behalf of a legal entity, you guarantee that you have all the necessary powers to accept these Terms on behalf of such organization. If you do not agree with any of the points, please immediately stop using the site.
01Intellectual Property and Content Protection
- All content, functionality, and infrastructure presented on the Company's website, including but not limited to: analytical reports (Market Intelligence), texts, graphics, logos, user interface elements (UX/UI), audio and video materials, database architecture, as well as proprietary ESG assessment methodologies and source software code (including NLP algorithms and machine learning models), are the exclusive intellectual property of Xplorence or our official licensors and are protected by national and international copyright laws.
- The Company grants you a limited, non-exclusive, revocable license solely for personal, non-commercial viewing of website materials. Any copying, reproduction, distribution, reverse engineering of algorithms, decompilation, creation of derivative works, or commercial use of the site materials without prior written consent from the Company is strictly prohibited. You are also prohibited from using framing, mirroring, or hidden meta-tags using Xplorence trademarks.
- In the event that you voluntarily send us ideas, feedback, or suggestions for improving our services (Feedback), you agree that Xplorence has the right to use these ideas without any obligation to pay you compensation or maintain their confidentiality.
02Informational Nature of Materials and AI Disclaimer
Xplorence applies cutting-edge technologies, including autonomous AI agents, predictive analytics, and natural language processing (NLP), to provide innovative solutions. Interacting with the site, you must understand and accept the following limitations:
- No Professional Guarantees or Fiduciary Obligations:Articles, benchmarks, case studies, market reviews, and any other materials published on the site for public access are for general information only. They do not under any circumstances replace or constitute official financial, legal, tax, technical, or investment advice. Use of the site does not create a fiduciary or client relationship between you and Xplorence.
- Generative Content and AI Hallucinations:If you interact with chatbots, search algorithms, or AI interfaces on our site, you acknowledge that responses are generated by artificial intelligence in real-time. Despite our efforts to calibrate the algorithms, AI may produce inaccurate, incomplete, outdated, or logically erroneous information (so-called 'hallucinations'). The Company expressly assumes no responsibility for any business decisions, investments, or operational actions taken by you solely based on such automated responses.
03Acceptable Use of the Site and Cybersecurity
You agree to use the Xplorence website solely for lawful, ethical purposes and in accordance with applicable law. It is strictly prohibited to:
- Use automated systems (bots, spiders, parsers, scrapers) to extract data from our Expert Pool, client portals, databases, or site directories.
- Perform actions aimed at disrupting the normal functioning of the site's infrastructure, attempts to bypass authentication systems, scanning for vulnerabilities, as well as organizing DDoS attacks or introducing malicious code (viruses, Trojans, ransomware).
- Use the site to distribute knowingly false information, spam, extremist materials, or content that defames the business reputation of the Company, its partners, international donors, or Expert Pool participants.
- Use the platform for any actions related to money laundering, violation of international sanction regimes, or illegal collection of third-party personal data.
04Third-Party Links and Integrations
- For the convenience of users, our site may contain hyperlinks to third-party web resources (e.g., official sites of international partners such as the UN, ADB, EBRD, EdTech platforms, government portals, or news agencies).
- Xplorence does not control these resources, does not automatically endorse their content, and is not responsible for their privacy policies, data security, or the quality of services they provide. Accessing any third-party links and providing data on such sites is done solely at your own risk.
05Disclaimer of Warranties (As Is) and Limitation of Liability
The platform and all its content are provided 'AS IS' and 'AS AVAILABLE', without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement of intellectual property rights. We do not guarantee that the site will operate uninterrupted, without error, or that discovered defects will be immediately corrected.
- Limitation of Liability:To the maximum extent permitted by applicable law, Xplorence, its founders, directors, partners, agents, and employees shall not be liable for any direct, indirect, incidental, special, or punitive damages. This includes, but is not limited to, lost profit, loss of data, damage to reputation, business interruption, or costs of replacement software resulting from:
- Your access to the site, use of its content, or inability to use it (due to technical failures or scheduled maintenance).
- Unauthorized access by third parties to our secure servers and/or any personal information stored on them.
- Actions of circumstances beyond our control (force majeure), including natural disasters, power outages, global disruptions of Internet providers, or government blocking.
06Applicable Law, Dispute Resolution, and Changes to Terms
This Agreement is governed by, construed, and enforced in accordance with the substantive and procedural laws of the Republic of Uzbekistan.
- Pre-court Settlement:Any disputes, disagreements, or claims arising out of or in connection with this Agreement are subject to mandatory pre-court settlement. A claim must be submitted in writing to the Company's official address. The response time for a claim is 30 (thirty) calendar days from its receipt.
- Jurisdiction:If a dispute cannot be resolved through constructive negotiations, it shall be referred to the competent judicial authorities at the place of the Company's official registration in Tashkent, Uzbekistan.
- Severability:If any provision of this Agreement is found by a court to be invalid or unenforceable, the remaining provisions of the Agreement shall remain in full force and effect.
- Changes:Xplorence reserves the right to change these Terms at any time without prior personal notice. The current version is always published on this page with the update date. Your continued use of the site after changes are made signifies your full consent to the updated version of the Agreement.
